OpenNutrition is a mobile app designed to help you track your macros, receive personalized diet recommendations, and monitor your fitness goals. Because we care deeply about user privacy, we try to limit the data we collect to what is necessary to use the app and connect with friends.
Below, we outline what data we collect, how we use and share it, and your rights.
When you sign up for an account on OpenNutrition, you may be asked to enter personal information such as your name, phone number (if you choose to enable SMS-related features), height, weight, sex, and other relevant body metrics. This data is used to identify you and personalize your experience on the app.
When you use the app, we automatically collect certain information about your device (such as the type of device, operating system, IP address, and unique identifiers) and how you interact with the app (such as the actions you take and how long you use the app). We use this information to improve the app, create new features, and keep our systems secure.
If you visit our website, we may collect basic technical information (e.g., IP address, browser type, and browsing actions) to operate and improve our Services.
We may use third-party analytics services to help us understand how users engage with the app and to troubleshoot technical issues. These services may receive device identifiers or other usage data for these purposes.
We do not sell, rent, license, or lease your data to third parties. However, we may share it with the following third parties:
Service Providers: such as hosting services, customer support services, and analytics services.
Professional Advisors: such as lawyers and accountants.
Business Transaction Recipients: including counterparties and others assisting with a merger, acquisition, financing, reorganization, bankruptcy, receivership, dissolution, asset sale, or similar transaction involving our business.
Legal and Safety: government authorities or regulators or other third parties where required by law or legal process or to protect OpenNutrition, users’, or other third parties’ rights and safety.
You can use OpenNutrition to share your progress, goals, and achievements. When you share data, it may include your name, relevant body metrics, and other personal information you choose to share.
We keep your data until we don’t need it for the purposes described in this policy and we have no legal obligation to keep it.
We provide all users with the following rights:
Deactivate: you can deactivate your account so that you will not be able to send or receive new updates.
Access: you can download the data we have about you, where it is required by law.
Delete: you can request that we delete the data we have about you, but this right is not absolute. We may need to keep certain information, for example, to comply with our legal requirements.
Correct: you can ask that we fix any errors or inaccuracies in the data we hold about you.
Stop processing: you can tell us to stop processing your data.
Object: you can object to how we process your data.
Complain: you can complain to the data protection regulator where you live (if you have one).
You can exercise these rights by contacting us through the app or emailing us at legal@opennutrition.app and providing the phone number, if any, associated with your account in your message. We will not treat you differently if you exercise any of these rights, but we may need additional information to verify your identity. An agent can also make these requests on your behalf, but we may still ask you to verify your identity and that you have authorized the agent to act on your behalf.
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These rights include:
Right to Know: You can request information about the categories and specific pieces of personal information we have collected, the categories of sources for that information, the business purpose for collecting it, and the categories of third parties with whom we share it.
Right to Delete: You can ask us to delete your personal information, subject to certain exceptions (for example, if we are required by law to keep it).
Right to Opt Out of Sale/Sharing: We do not sell personal information. If we decide to sell or share data in the future in a manner covered by the CCPA, we would provide you with a method to opt out.
Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.
You can exercise these rights by contacting us through the app or by emailing legal@opennutrition.app and specifying that you are a California resident making a “CCPA request.” We may need certain information from you (such as the phone number associated with your account, if applicable) to verify your identity and process your request. If you use an authorized agent to submit a request, we may ask you to verify your identity and that you have authorized the agent to act on your behalf.
OpenNutrition is not intended for children under 13, and we do not believe we have collected any data from children under 13. If we learn that we have collected data from children without proper consent, we will delete that data.
We may need to update this policy to account for changes in our business and applicable laws. If we change this policy, we will post the new version here. If the changes are significant, we will notify you through the app.
